Informant disclosure ruling overturned

The British Columbia Court of Appeal has rejected a lower court ruling that ordered edited police documents containing intelligence from confidential informers be disclosed to defence counsel for the purpose of challenging the validity of a search warrant.

Many eyes were watching for the decision in R. v. McKay 2016 BCCA 391, after Supreme Court Justice Brian MacKenzie stayed proceedings against a man accused of trafficking cocaine when the Crown refused to comply with the disclosure order.
