Internet ban for sex offenders deemed 'too harsh'

A recent Ontario Court of Appeal decision may signal a growing reluctance by judges to issue prohibition orders banning convicted sex offenders from using the Internet.

The unanimous, Oct. 5 ruling in R. v. Brar 2016 ONCA 724, is the first provincial Appeal Court decision dealing with s. 161 prohibition orders under the Criminal Code since the Supreme Court of Canada’s July 21 finding in R. v. K.R.J. 2016 SCC 31.
