Application by General Motors of Canada (GM) for an order requiring Trillium Motor World (Trillium) to pay $5,353,134 in security for costs of its appeal. The costs sought represented the costs awarded to GM following its successful defence of Trillium’s action, less $500,000 in security for costs already paid by Trillium, plus $375,128, an estimate of GM’s partial indemnity costs to respond to the appeal.
