Appeal by Arch Insurance Canada Ltd. (Arch) from a determination that it had a duty to defend the Financial and Consumer Services Commission (Commission) and from a costs order. The Commission investigated individuals who sold securities. Arch alleged that individuals caused to be published, distributed, and released to members of the media, statements that were defamatory and that related to an investigation by the Commission over an alleged interprovincial Ponzi scheme.
