Appeal by the Toronto Police Services from a youth court judge’s ruling dismissing its application to disclose records concerning a young person, LD. LD alleged he had been assaulted by Mignardi while detained at a youth facility, leading to police disciplinary proceedings against Mignardi. The judge held that the fundamental principle of diminished moral culpability made the records sought irrelevant to the purpose of assessing the credibility of LD’s allegations against Mignardi.
