Appeal by the Canadian National Railway Company (CN) from a decision by the Canadian Transportation Agency (Agency) in favour of the respondent, Louis Dreyfus Commodities Canada (LDC). LDC operated grain elevator facilities in Saskatchewan and Alberta. In 1999, it entered into a confidential contract with CN for transporting canola and wheat. For several weeks during the 2013/2014 crop year, LDC did not receive all of the railcars it ordered to its facilities and accordingly filed a complaint with the Agency.
