Judge wrong to disallow fine, appeal court rules

The Ontario Court of Appeal has ruled that an Ontario Superior Court judge erred in 2013 when he refused a Crown request to impose a $1.03 million fine in lieu of forfeiture on a Toronto man who defrauded his employer of more than $900,000 — and then committed fraud again when he was on interim release from the sentence imposed in the first fraud.
