Tie vote on disciplinary appeal rejected

With a bylaw in place requiring committee decisions to be made by a majority vote, the Alberta Teachers’ Association (ATA) shouldn’t have dismissed the appeal of a disciplinary matter on a tie, the province’s highest court has ruled.

The unanimous decision in Green v. Alberta Teachers’ Assn. 2016 ABCA 237 orders a five-member panel of the ATA’s Professional Conduct Appeal Committee to reconsider teacher Cynthia Green’s appeal of a finding of unprofessional conduct.
