Many are celebrating Mou v. MHPM Project Leaders [2016] HRTO 327, a recent decision by the Human Rights Tribunal of Ontario, in which miscarriages were found to be a disability under the Human Rights Code of Ontario. In the March 14 interim decision written in response to an employer’s request to dismiss the application, vice-chair Jennifer Scott found that a woman who was fired after experiencing a severe and disabling depression as a result of a miscarriage was entitled to protection under the Code.
