Court of appeal upholds Ontario Securities Commission rules of procedure

The Ontario Court of Appeal has upheld a decision by the divisional court in favour of the Ontario Securities Commission (OSC).

In Ontario Securities Commission v. MRS Sciences Inc. 2017 ONCA 279, released on April 4, the court determined that “no procedural unfairness or breach of natural justice in constituting a different sanctions panel” was found after commissioners involved in a merits hearing ended their terms before the sanctions hearing took place.
