Appeal over damages award for loss of use of a Ferrari dismissed

A Ferrari owner's appeal of a damage award was dismissed last week by the British Columbia Court of Appeal after it determined the trial judge properly considered how the car would have been used by the appellant had it not been detained.

The appellant, Dr. Lawrence Miller, purchased a Ferrari F430 in 2011. It was negligently damaged by the respondent, Brian Ross Motorsports Corp., a luxury car dealership that wrongfully detained the vehicle for nine months. Miller and the dealership settled the claim for repair costs...
