Administrative law ruling from B.C. court clarifies 'internal standard of review'

A pair of decisions from the British Columbia Court of Appeal may offer a glimpse into an important future area for administrative law.

In Harding v. Law Society of British Columbia 2017 BCCA 171 and Vlug v. Law Society of British Columbia 2017 BCCA 172, the court heard appeals by two B.C. lawyers found to have committed professional misconduct.

The cases required the court to consider the “internal standard of review” that law society review boards should apply when scrutinizing hearing panel decisions.
