Appeal court tosses suit over unwanted child

A novel $4 million tort claim by a doctor who claimed he was tricked into having unprotected sex that resulted in the birth of a child he did not want has been rejected by Ontario’s high court.

In P.P. v. D.D. 2017 ONCA 180, the Court of Appeal for Ontario on March 2 found that the fraudulent misrepresentation claim, even if substantiated, could not succeed because it was not related to recoverable damages.
