Decision illustrates scope of new delay of action rule

The start of 2017 marked the commencement of the new administrative dismissal regime in Ontario. It is important that lawyers take note of the changes implemented in the current regime. Under the new Rule 48.14 of the Rules of Civil Procedure, the registrar shall automatically dismiss an action for delay if it has not been set down for trial by the later of five years after the commencement of the action or Jan. 1, 2017.
