Dear Editor:

While I disagree with much of what Brian Campbell writes, including his apparent strategic use of words like ‘conspire’ and ‘short-circuit’ when describing Tarion, there are a few important factual inaccuracies that need correction.

First, some important missing context. Tarion’s governing legislation, the Ontario New Home Warranties Plan Act, does not create an express statutory right for builders to appeal warranty assessments. Other avenues are available to builders, but Tarion acknowledges that in certain circumstances, a simpler challenge mechanism for builders is appropriate....
