Protocol clarifies notice of publication ban process

Whether one is a proponent for protection of individual privacy or the open court principle, Ontario lawyers need to be alert to the new protocol that has been launched by the Ontario Superior Court of Justice for notice to be provided to the media when seeking discretionary publication bans, sealing orders and closed-door hearings. This protocol became effective on July 1, 2016, and applies uniformly in civil, criminal and family law proceedings.
