Thornton Grout Finnegan student wins MacNaughton writing award

Thornton Grout Finnigan articling student James Hardy is the recipient of the 2017 Michael MacNaughton Student Writing Award for insolvency law.

His paper titled “Equitable Subordination in CCAA Proceedings” explores the Supreme Court of Canada’s decision to grant leave to appeal from the Court of Appeal for Ontario’s decision in U.S. Steel Canada Inc. (Re) which had held that equitable subordination is not available in proceedings under the Companies’ Creditors Arrangement Act.

The late Michael MacNaughton was one of the leading insolvency lawyers in Canada and was well known for his consistent contributions to the body of literature in the area of insolvency and restructuring.

The award will be presented by the Ontario Bar Association (Insolvency Law Section) at the Commercial List Users’ Committee annual retreat on May 31, 2017.
