Slip and falls: technology putting more science into friction

The litigation of slip and fall claims in Ontario is changing with the advance of technology.

The Occupiers’ Liability Act, which came into force in 1980, created a statutory duty on occupiers, set out in s. 3(1) of the act which states, in general terms, that an occupier of a premise owes a duty to take such care as in all the circumstances of the case that is reasonable to see that persons entering the premises are reasonably safe while on the premises.
