Ontario Court of Appeal upholds City of Toronto hookah ban

The Ontario Court of Appeal has upheld the City of Toronto's ban on hookah lounges.

In 232169 Ontario Inc. (Farouz Sheesha Café) v. Toronto (City) 2017 ONCA 484, the court heard that in 2015 the City of Toronto passed a bylaw to prohibit the use of hookah devices in premises or vehicles licensed by the city. Bylaw 131-2015 bans the “inhaling or exhaling of smoke from a hookah, as well as the holding of an activated hookah.”
