Ontario appeal court clarifies ordering of victim surcharges

The Ontario Court of Appeal has determined that victim surcharges cannot be ordered concurrently in a case involving a stolen half wheel of cheese and a pack of razor blades.

Lauren Binhammer, Henein Hutchison LLPIn R. v. Fedele 2017 ONCA 554, the court heard that the respondent, Cesare Fedele, on two separate occasions had stolen half a wheel of cheese and a pack of razor blades. The thefts took place six months apart and Fedele pleaded guilty to two counts of theft under $5,000.
