Updated: Court overturns convictions in case involving traffic stop, marijuana

The Ontario Court of Appeal has overturned firearms and drug trafficking convictions for a man as aspects of the arrest breached his Charter rights.

Ghazala Zaman, Crown counsel In R. v. Gonzales 2017 ONCA 543, the court heard that the appellant, Gilbert Gonzales, was subject to a traffic stop, which led to the search of the vehicle he was driving, his house at 31 Hislop in Markham, Ont., and a strip search when under arrest.
