Alberta Court of Appeal dismisses bid for stay of licence suspensions

The Alberta Court of Appeal has ruled that Albertans may not apply to the Court of Queen’s Bench for a stay of their licence suspension while s. 88.1 of the Traffic Safety Act’s declaration of invalidity is pending.

On May 18, 2017, the Court of Appeal determined that the administrative licence suspension regime enforced under the province's Traffic Safety Act “is overbroad and grossly disproportionate, it also cannot be demonstrably justified in a free and democratic society.”
