Copyright decisions provide nuanced look at paywall-protected news articles

An Ottawa-based subscription news service has received two very different judgments from the courts regarding unauthorized access to its paywall protected articles.

In 2015, Blacklock’s Reporter (Blacklock’s) successfully sued a wine association for copyright infringement in Ottawa small claims court and was awarded $11,470 in compensatory damages and $2,000 in punitive damages. A year later, the news service sued the Department of Finance (Department) on a similar fact scenario in Federal Court. Their action was dismissed, with $65,000 in costs awarded to the department.
