Court ruling in coffee-spill lawsuit brings Canada one step closer to U.S. experience

As a matter of public policy, judicial decisions are supposed to be made with a view to promoting the type of conduct that the citizens of Canada are entitled to expect of each other. In my view, this would include the expectation that people take responsibility for their own negligent conduct.

The recent decision of the Ontario Court of Appeal in Dittmann v. Aviva Insurance Company of Canada 2017 ONCA 617 represents an interesting perspective on this point.
