Court rules on continuity of employment in action against termination clause

The Ontario Court of Appeal has ordered that an action should proceed to trial after it ruled the motion judge erred in concluding a termination clause in an employment agreement was unenforceable due to lack of consideration.

In Krishnamoorthy v. Olympus Canada Inc. 2017 ONCA 873, the court heard that the respondent, Nadesan Krishnamoorthy, had worked for a company called Carsen Group Inc., a distributor for Olympus America Inc. products in Canada.
