Court of Appeal identifies ‘double recovery’ in commercial tenancy dispute

The Ontario Court of Appeal has reviewed private law damages in a decision regarding a commercial tenancy dispute between a golf academy and the golf club it was leasing land from near Tecumseh, Ont.

The court heard in 2105582 Ontario Ltd. (Performance Plus Golf Academy) v. 375445 Ontario Limited (Hydeaway Golf Club) 2017 ONCA 980, that the appellant, the Hydeaway Golf Club, had leased land to the respondent, the Performance Plus Golf Academy, under an oral agreement.
