Court rules parties can contract out of statutory provisions in gas pipeline case

The Ontario Court of Appeal has allowed an appeal in a case involving municipal drainage work, ruling that parties can contract out of statutory provisions.

Crawford Smith, Torys LLPIn Union Gas Limited v. Norwich (Township) 2018 ONCA 11, the court heard that a conflict between a Union gas pipeline and drainage work was identified during an assessment of improvements for the Otter Creek Municipal Drain, in Norwich Township in southwestern Ontario. This conflict meant the gas pipeline needed to be moved.
