Federal Court of Appeal gives guidance to CPP filing obligations of retired business partners

A Federal Court of Appeal decision to reverse a tax assessment demanding a Canada Pension Plan payment from a former executive will guide future cases involving arranged income for retired partners of business firms, lawyers say.

The Canada Revenue Agency’s ability to demand a CPP income tax contribution from the allocated, post-retirement income of a former partner in a big accounting firm sat at the heart of the June 4 Federal Court of Appeal decision in Freitas v. Canada 2018 FCA 110.
