Appeal by the plaintiffs, Cropvise Incorporated and Wolf & Wolf Seeds, from dismissal of their action against the defendant, the Canadian Food Inspection Agency (CFIA). The plaintiffs had contracts to supply seed potatoes for export to Venezuela. Initial shipments entered Venezuela without incident. In 2009, 16 of 50 containers were rejected for entry by the Venezuelan authorities for failure to meet the standards represented in Phytosanitary Certificates issued by the CFIA pursuant to a Bilateral Potato Protocol between Canada and Venezuela.
