Petition by the Canadian Plastic Bag Association to set aside a bylaw. The City of Victoria enacted a bylaw that prohibited businesses from providing single-use plastic bags to customers and required a mandatory minimum fee for reusable bags. The Association argued that the bylaw was an environmental regulation, such that the City could not enact it without Provincial approval, and that the City could not compel a minimum fee.
