Legal experts mixed on chances of success for provincial challenges to federal carbon tax

Ottawa and a number of provinces will soon be facing off in court regarding the federal carbon tax. But experts are divided on who has the best legal leg to stand on.

The newly-minted Progressive Conservative government of Ontario announced Aug. 2 it was bringing the federal Greenhouse Gas Pollution Pricing Act, which gives Ottawa the ability to impose a carbon tax on provinces, to the provincial Court of Appeal, arguing it imposed an unconstitutional tax on Ontarians.
