Application by three plaintiff police officers challenging the Police Chief’s authority to withhold their pay. The Police Chief relieved the plaintiffs from duty without pay relative to criminal allegations against them. The allegations relating to two plaintiffs, who were subsequently convicted, arose from off-duty behaviour. The allegations against the third plaintiff, who was eventually acquitted, arose from on-duty behaviour. The plaintiffs’ internal disciplinary hearings were pending.
