Motion by the plaintiffs Aroland First Nation and Ginoogaming First Nation for partial summary judgment. The First Nations were seeking a declaration that the Crown’s duty to consult was triggered in the circumstances of this case. They were seeking the recognition of a duty to consult in relation to ongoing invasive testing on established natural gas pipelines that traversed the First Nations’ traditional territories in northern Ontario.
