Appeal by the Crown from the stay of proceedings granted to the respondent Klassen. After a lengthy investigation, including six months of wiretap interceptions, Klassen and his co-accused were charged with conspiracy to import cocaine. The proceedings had been adjourned several times for Klassen to get counsel. The trial was adjourned four times. The fourth trial was an overbooking and could not proceed because no judge was available. The total time from when the Information was sworn to the anticipated end of trial was 57 months...
