What the Canyon Meadows assault decision means to municipalities

In the recent decision McAllister v. Calgary (City) 2018 ABQB 480, the City of Calgary was found liable by the Alberta Court of Queen’s Bench for a random and unprovoked assault which occurred on New Year’s Eve.

The assault occurred at the Canyon Meadows LRT station. Kyle McAllister was walking across the Plus 15 aerial skywalk to the LRT station when he was suddenly and violently attacked by a group of random intoxicated minors. He suffered numerous injuries and subsequently brought a lawsuit against the municipality...
