Wording of benefits statute key in N.L. Appeal Court ruling over workplace injury

The meaning of “use of a motor vehicle” was the nexus of a Newfoundland appeal involving a workplace accident where a mechanic was crushed while fixing a company truck.

Weir’s Construction Limited v. Warford (Estate) 2018 NLCA 5, decided Jan. 22, was a decades-old case involving a serious injury to an employee and subsequent legal action by his estate in its quest for compensation beyond standard workplace accident benefits.
