Alberta Court of Appeal rules judge erred in applying fraud test in well drilling case

The Alberta Court of Appeal has ruled a lower court judge did not properly apply the test for fraud in a case surrounding liability over the botched drilling of an oil well.

The appeal in Precision Drilling Canada Limited Partnership v. Yangarra Resources Ltd. 2017 ABCA 378, released Nov. 10, deals with Yangarra’s appeal of the decision of a chambers judge who granted summary judgment in favour of Precision.
