Wellness: Work/life integration | Darryl Singer

Much talk in recent years in our profession has been about the seemingly unattainable work/life balance. The concept sounds great in theory. But the reality is that for most lawyers who aspire to achieve or maintain success, it is almost impossible. ... [read more]

Let innovation stop crime | Murray Fallis

Governments get a reputation for being slow and bureaucratic. Heck, it is rumored that Statistics Canada first got external Internet in 2017. Yet, if government is the tortoise in a hare’s world, then Correctional Service Canada (CSC) is the three-toed sloth. ... [read more]

Focus on client: Developing client-centric practice | Jo-Anne Stark

Dear Jo: I’ve been a lawyer for many years, and I feel as though I give excellent service to my clients. Yet I still find that when I send out my bill, many clients don’t seem to appreciate the effort or the outcome achieved. Am I doing something wrong? ... [read more]

How about a big hand for the doctor? | Marcel Strigberger

Painless dentist? That is no pain for the dentist. A dentist in the city of Biella, Italy, who wanted to get a proof of COVID-19 vaccination certificate but did not want the shot attended at a clinic and tried to trick the staff by wearing a fake rubber hand. Actually he was wearing a silicone covering on his torso with two rubber arms. The astute nurse noticed something strange about the skin, it being cold and gummy. I believe what really gave the con attempt away was the imprinted logo on the arm, of the Goodyear blimp. ... [read more]

Duty to Rescue Act 2021 | Marvin Zuker

How often do we read about sexual assaults and other violent crimes and as often third parties simply disregard them, if not enabling them to occur? Can you imagine a morality, a culture, where people intervene, speak up, and just do the right thing? Silence is complicity. It is not about a lack of awareness. It is about the failure to act. ... They call me Columbo: Psychology of negotiation and litigation | Anthony Giannotti

The genesis of this article arises from routine comments that I hear and read from other lawyers about judges, mediators and adjusters being particularly aggressive, obstinate or otherwise difficult in general. As we all know, the same case tried before five different judges can yield five remarkably different results — the same evidence, same presentation but different outcomes. The same is true with mediation. Some lawyers achieve far better results with similar evidence using the same mediator and same adjuster or defence counsel. ... [read more]

Adequate health care for prisoners? | John L. Hill

Parliament has enacted as a guiding principle for the Correctional Service of Canada (CSC) that offenders retain the rights of all members of society except those that are necessarily removed or restricted as a consequence of the sentence. We, as Canadians, accept that torture is impermissible because deprivation of liberty is the only legitimate punishment. One goes to prison as punishment, not for punishment. ... [read more]

How to stick it to your resolutions | Marcel Strigberger

We are nearing that time of year again; resolution time. I note many of us make resolutions on how to optimize practice habits. The demon, however, with resolutions is most people don’t stick to them. Now happily retired, I made a resolution to share some of my resolution experiences. ... [read more]

Beatles documentary lessons for lawyers, businesses | David Israelson

Anyone who watched the entire six hours of The Beatles: Get Back documentary that was just released on Disney Plus will likely have mixed feelings. It bursts the bubble for fans of the Fab Four to watch them dithering and bickering back in 1969. ... [read more]
